Terms of Service

1. Agreement Overview

These Terms of Service ("Agreement") govern your participation in the AI TestList Affiliate Program ("Program"). By registering as an affiliate, you agree to be bound by these terms.

2. Eligibility

  • You must be at least 18 years old.
  • You do not need to be an AI TestList customer to become an affiliate.
  • You must provide accurate and complete information during registration.
  • You must have a valid PayPal account to receive payments.

3. Commission Structure

  • Commission Rate: 50% of the subscription amount for each referred customer.
  • Duration: Commissions are recurring for as long as the referred customer maintains an active paid subscription.
  • Attribution: First-click attribution. The first affiliate link clicked receives credit for the referral.
  • Cookie Duration: 90 days. If a visitor clicks your link and signs up within 90 days, you receive credit.

4. Payment Terms

  • Payment Method: All payments are made via PayPal to your PayPal account.
  • Payment Schedule: Payments are processed monthly.
  • Minimum Payout: $200 CAD. Commissions below this threshold will roll over to the next month.
  • Holding Period: Commissions become available for payout 30 days after the customer payment to allow for refunds.
  • Currency: All commissions are calculated and paid in Canadian Dollars (CAD).

5. Clawback Policy

If a referred customer requests and receives a refund, the associated commission will be deducted from your available balance ("clawback"). This applies to both full and partial refunds.

6. Prohibited Activities

The following activities are strictly prohibited and may result in immediate termination:

  • Spam: Sending unsolicited emails, messages, or comments promoting your affiliate link.
  • Brand Bidding: Running paid ads (Google Ads, Facebook Ads, etc.) targeting "AI TestList" or similar brand terms.
  • False Advertising: Making false claims about AI TestList features, pricing, or guarantees.
  • Cookie Stuffing: Using hidden iframes, pop-unders, or other methods to drop affiliate cookies without user consent.
  • Self-Referrals: Creating accounts to claim your own referral commissions.
  • Incentivized Clicks: Offering rewards, money, or incentives for clicking your affiliate link.
  • Malware/Adware: Using malicious software to generate referrals.
  • Inappropriate Content: Promoting AI TestList on websites containing illegal, adult, violent, or discriminatory content.

7. Your Responsibilities

  • You are responsible for your own promotional content and methods.
  • You must clearly disclose your affiliate relationship where required by law.
  • You must not misrepresent yourself as an employee or official representative of AI TestList.
  • You are responsible for any taxes on your affiliate earnings.

8. Intellectual Property

AI TestList grants you a limited, non-exclusive license to use our name, logo, and promotional materials solely for promoting the Program. You may not modify our trademarks or create materials that could be confused with official AI TestList communications.

9. Termination

  • AI TestList may suspend or terminate your affiliate account at any time, with or without cause.
  • You may terminate your participation at any time by contacting us.
  • Upon termination, all unpaid commissions will be paid in full within 30 days, including amounts below the minimum payout threshold.

10. Changes

AI TestList reserves the right to modify these terms, commission rates, or program structure at any time. We will notify you of significant changes via email at least 30 days in advance. Continued participation after changes take effect constitutes acceptance of the new terms.

11. Limitation of Liability

AI TestList is not liable for any indirect, incidental, or consequential damages arising from your participation in the Program. Our total liability shall not exceed the commissions earned by you in the previous 12 months.

12. Governing Law

This Agreement is governed by the laws of the Province of Quebec, Canada. Any disputes shall be resolved in the courts of Quebec City, Quebec.
